Rootes vs. Martin Perks, Mary Anderson Perks, and Benjamin Toler. Tompkins' deposition discusses the conditions of buildings at Gould Hill. The will book containing Smith's will is no longer extant

He may have represented Goochland County, Virginia, in the House of Burgesses from 1752 to 1761. Smith represented Hanover County in the House of Burgesses from 1772 until his death before 4 March 1773.
