- Bankruptcy notice, 1868, issued out of the District Court of the United States in Virginia to James D. Johnston (1828-1897) announcing action against the estate of John R. Douthat (b. 1830), a debtor to Mr. Johnston. The notice announces that the appointment of assignees will be held at a bankruptcy court on 7 May 1868 in Abingdon, Virginia. Also contains an itemized list of the creditors' bills for the estate

- James David Johnston, Sr. was born at Pearisburg, Giles County, Virginia on 29 Sept. 1828 as the son of Colonel Andrew Johnston and Jane Henderson Johnston. He attended private schools in Giles and Botetourt Counties and graduated in 1848 from Emory & Henry College. At the age of 21 he was admitted to practice law and had for many years a law practice with Albert G. Pendelton. He also maintained an office with Judge David E. Johnston, a relative residing in Princeton, West Virginia. James D. Johnston also served as commonwealth attorney of Giles County (1856-1865) and was a member of the House of Delegates from 1877-1879. In 1891 James David Johnston moved with his family to Roanoke, Virginia and spent the last six years of his life there. He died 14 Nov. 1897.
- On 13 Nov. 1855, James D. Johnston married Mary Ann Fowler in Monroe County, West Virginia. The couple had five children, the most prominent of whom was their son attorney James David Johnston, Jr.
